These Terms of Service govern your use of N.O.S.E. Notebook, operated by Agility Automations. By creating an account or using the app or website, you agree to these terms. If you do not agree, please do not use the service.
Eligibility
You must be at least 18 years old to use N.O.S.E. Notebook. By creating an account, you represent that you meet this age requirement and that the information you provide is accurate.
Your account
You are responsible for keeping your account credentials confidential and for all activity under your account. Notify us immediately at hello@nose.lab if you suspect unauthorized access.
License to use the service
We grant you a limited, non-exclusive, non-transferable, revocable license to use N.O.S.E. Notebook for your personal, non-commercial use. You may not reverse engineer, scrape, resell, or use the service to build a competing product.
Acceptable use
You agree not to upload content that is unlawful, infringing, harmful, harassing, or violates another person's rights. You agree not to use the service to abuse, defame, or impersonate others.
Your content
You retain ownership of the posts, ratings, and notes you create. By posting publicly, you grant us a non-exclusive license to display, distribute, and promote that content within the service. You can delete your posts at any time.
Our content
The fragrance database, recommendation outputs, design, software, and brand assets of N.O.S.E. Notebook are protected by intellectual property law and remain the property of Agility Automations or its licensors.
Recommendations are subjective
Fragrance recommendations are personal and inherently subjective. We do our best to match your profile thoughtfully, but we make no warranty that any recommendation will suit your taste, occasion, or skin chemistry. Fragrance purchases are at your own discretion and risk.
Disclaimers
The service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, secure, or error-free.
Limitation of liability
To the maximum extent permitted by law, Agility Automations is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability for any claim is limited to the greater of (a) the amount you paid us in the preceding twelve months, or (b) one hundred US dollars.
Termination
We may suspend or terminate your account for breach of these terms. You may close your account at any time from within the app. Sections that by their nature should survive termination — including ownership, disclaimers, and limitation of liability — will survive.
Governing law
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Delaware.
Changes
We may update these terms periodically. We will notify you of material changes by email and update the date above. Continued use of the service after a change indicates acceptance.
